User Agreement

Introduction

Welcome to our Online Store. Below are the terms and conditions governing your use of this Store and all legal effects resulting from your use of the Store's online services via this platform. Any person’s use of the Store—whether as a consumer of a service or product or otherwise—constitutes their full legal consent and acceptance of all articles and provisions of this Agreement. It is an affirmation of your commitment to its regulations. This Agreement is effective and enforceable upon your consent and the commencement of registration at the Store, pursuant to Article 10 of the Saudi Electronic Transactions Law.

Article 1: Introduction and Definitions

The above preamble is an integral part of this Agreement. The following terms shall have the meanings assigned to them below:

  1. (The Store): Includes all forms of the Store on the World Wide Web, whether an electronic application, a website, or a commercial outlet.
  2. (The Consumer): Any person engaging in electronic commerce with the intent of obtaining products or services provided by the Store via its electronic platform.
  3. (The Agreement): Refers to the terms and conditions of this Agreement, which govern and regulate the relationship between the parties.

Article 2: Legal Capacity of the Consumer

  1. The Consumer acknowledges that they possess the recognized legal capacity under Sharia and statutory law to deal with the Store, or that they are at least eighteen (18) years of age.
  2. The Consumer agrees that if they violate this article, they shall bear the consequences of such violation before third parties.

Article 3: Nature of Obligation

  1. The Store’s obligation to consumers is to provide the (Service or Product).
  2. The Store may provide other services, such as after-sales services or other related services, depending on the nature and type of the (Service or Product) requested.

Article 4: Usage Guidelines

  1. The Consumer undertakes to use the Store's electronic platform in accordance with public morals and the laws in force in the Kingdom of Saudi Arabia.
  2. The Consumer undertakes, when purchasing a service or product, not to use said service or product in any way that violates public morals or the laws of the Kingdom of Saudi Arabia.

Article 5: Accounts and Registration Obligations

Upon applying for membership in this Store, you are committed to disclosing specific information and choosing a secret username and password. By doing so, you agree to:

  1. Be responsible for maintaining the confidentiality of your account information and password. You agree to notify the Store immediately of any unauthorized use of your account or any other breach of your confidential information.
  2. The Store shall not, under any circumstances, be liable for any loss—direct or indirect, moral or material—resulting from the disclosure of your username or login information.
  3. You are committed to using your account personally; you are fully responsible for it. Use by others constitutes a presumption that you have authorized them to use the Store in your name and for your account.
  4. You commit to using the Store with seriousness and credibility.
  5. You commit to disclosing true, accurate, updated, complete, and legal information about yourself as required during registration and to update your data if it changes.
  6. The Store is committed to treating your personal information and contact addresses with strict confidentiality.
  7. If it appears that you have disclosed information that is untrue, inaccurate, outdated, incomplete, illegal, or in violation of this Agreement, the Store reserves the right to suspend, freeze, or cancel your membership and account without prejudice to the Store's other legal rights.

Article 6: Electronic Communications and Official Means of Communication

  1. The parties agree that communication shall be conducted via the email registered on the platform.
  2. The Consumer agrees that all agreements, advertisements, disclosures, and other communications provided electronically serve as written equivalents and are legally binding.
  3. The Consumer agrees to be notified of any provisions regarding this Agreement or dealings through general messages sent to all users or specific users.

Article 7: Amendments to the Agreement and Fees

  1. If any article or clause in this Agreement is cancelled or becomes unenforceable, the validity of the remaining articles and clauses remains in effect until further notice from the Store management.
  2. This Agreement—which may be amended from time to time—constitutes the mechanism of work and understanding between the Consumer and the Store.
  3. The Store may impose fees on some consumers depending on the offers, products, or services requested, or as required by the State (e.g., taxes/VAT).
  4. The Store reserves the right to add, increase, decrease, or discount any fees or expenses under the terms of this Agreement.

Article 8: Payment and Settlement Services

  1. The Store, through its partners, provides an online payment system via the options available on the platform.
  2. The Store is committed to pricing services or products according to recognized market value.
  3. The Store is committed to providing invoices and receipts for all amounts paid by the consumer.
  4. The Store is committed to providing recognized accounting standards on its electronic platform in accordance with this Agreement.

Article 9: Intellectual Property

  1. All intellectual property rights of the Store are the full property of the Store, whether owned before or after the establishment of this platform.
  2. The Consumer shall respect the Store's intellectual property rights, including the Store name, words, logos, and other symbols displayed on the platform.

Article 10: Store Liability

  1. The Store is committed to conducting its business through this platform in a regular manner and in accordance with the laws of the Kingdom of Saudi Arabia and this Agreement.
  2. The Store is not liable for any claims arising from errors or negligence, whether caused directly, indirectly, accidentally, by the consumer, or by a third party (such as shipping companies).
  3. The Store and its owners undertake that the (Product or Service) is sound, legal, and authorized according to Saudi laws.

Article 11: Restriction of Access or Membership

The Store may suspend or cancel a Consumer’s membership or restrict their access to the platform's services at any time, without notice, and for any reason.

Article 12: Governing Law

This Agreement is governed and formulated according to the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia.

Article 13: General Provisions

  1. Arabic is the primary language for interpreting and translating this Agreement.
  2. Prices for services or products may be modified from time to time.
  3. Promotional or marketing offers are temporary; the Store reserves the right to modify or discontinue them at any time.
  4. The parties commit to dealing with each other in a manner that does not violate Sharia rules or relevant laws.
  5. This Agreement may only be cancelled by a decision issued by the Store management.
